O Tribunal a quo assentou que o testador estava em seu juízo perfeito, que elaborou o testamento por livre e espontânea vontade e confirmou a autenticidade da assinatura.
Em momento algum, os ora recorrentes alegaram que houve falsidade na assinatura ou que o testamento não refletiam a vontade do de cujus.
Contestou a inobservância na formalidade (art. 1.876, § 2º, CC/2002) para a confecção do ato, qual seja, a falta de leitura do testamento perante as três testemunhas reunidas concomitantemente.
Então, a Turma não conheceu do recurso, por entender que, apesar de ser um ato solene, não se deve priorizar a forma em detrimento da vontade do testador.
Ademais, na espécie, foi o próprio testador que levou o documento para as três testemunhas assinarem, restando induvidosa sua vontade.
