EMENTA: AGRAVO DE INSTRUMENTO. AÇÃO DE SEPARAÇÃO. ALIMENTOS DESTINADOS À SEPARANDA E À PROLE. ALTO PADRÃO DE VIDA. Se a remuneração alegada pelo alimentante é suficiente para proporcionar o mesmo alto padrão de vida que a família levava até o rompimento conjugal, convivência que ultrapassava uma década, os alimentos provisórios devem ser fixados em observância a tais possibilidades, viabilizando a melhor adaptação da separanda e, principalmente, da prole, à nova configuração da família. A sumariedade da cognição do recurso permite que os alimentos provisórios não sejam fixados com rigorismo em relação às despesas específicas da parte alimentada e à renda exata do alimentante, o que será objeto de melhor apreciação após a devida instrução do feito. DES. ALZIR FELIPPE SCHMITZ (RELATOR)
Trata-se de agravo de instrumento interposto por M.F.P. contra a decisão que fixou alimentos provisórios às agravadas em 15 salários mínimos do piso nacional.
Em síntese, o agravante alega, primeiramente, a ausência de necessidade da separanda em perceber alimentos. Nessa linha, sustenta que a separanda exerce atividade no ramo empresarial. Outrossim, em relação à necessidade das filhas, aduz que os valores foram superestimados pelas agravadas. Por final, frisa sua impossibilidade de arcar com valor fixado. Desse modo, requer o recebimento deste recurso agregando-lhe efeito suspensivo ativo e, ao final, a redução da verba alimentar.
Conforme a decisão de fl. 265, o recurso foi recebido tão-somente no efeito devolutivo.
O juízo a quo prestou informações à fl. 269.
As agravadas ofertaram contrarrazões às fls. 272/284.
O Ministério Público opinou pelo parcial provimento do recurso – fls. 189/197.

Eminentes Colegas, a discussão vertente diz respeito aos alimentos provisórios destinados às duas filhas dos separandos e à separanda, os quais foram inicialmente fixados em 15 (quinze) salários mínimos, e posteriormente majorados para R$ 12.000,00 (doze mil reais) por este Relator, em sede liminar.
Antes de mais nada, cumpre observar que estamos diante de um rompimento conjugal ocorrido após mais de 19 (dezenove) anos de convivência, em uma família de excelente padrão de vida.
De um lado, o varão é alto executivo, melhor dizer, vice-presidente de uma das maiores, senão a maior agência de publicidade e propaganda deste Estado, sendo que seus rendimentos mensais declarados no presente recurso correspondem a R$ 28.000,00 (vinte e oito mil reais). Refiro ser notório que cargos como o ocupado pelo recorrido são acompanhados de diversas facilidades, tais como bônus, participações em negócios, etc. Provavelmente este foi o motivo da ausência de juntada de sua declaração de imposto de renda. Mas, enfim, resta flagrante a boa remuneração do recorrente, e isso é incontroverso.
De outro lado, encontramos as agravadas: uma mulher de 45 (quarenta e cinco) anos de idade, que não trabalha há 15 (quinze) anos (cf currículo fl. 253/254), se dedicando exclusivamente aos cuidados com a família, em especial as filhas de 14 (quatorze) e 08 (oito) anos de idade. Tais filhas, ressalto, estão sob a guarda materna, vivendo na antiga residência da família, localizada na Zona Sul (Bairro Ipanema) de Porto Alegre, com piscina e jardim, evidenciando que tamanha estrutura certamente lhes proporciona muito conforto e, na mesma medida, muitas despesas. Ademais, existem as despesas características da idade das crianças, tais como escola particular, ballet, inglês, transporte, vestuário, lazer, etc...
Pois bem. Partindo de tais dados, esclareço que não olvido o exagero na estimativa de despesas apresentada pelas recorridas, mas ainda que se admita que houve supervalorização dos gastos das agravadas, não posso crer que o padrão de vida experimentado pela família até a separação será mantido com o valor fixado pelo juízo a quo, que corresponde a R$ 7.650,00 (sete mil, seiscentos e cinquenta reais) ao mês.
Ora, como manifestei quando da apreciação dos embargos declaratórios opostos pelo varão nos autos do agravo de instrumento nº 70034485656, muito me surpreende a alegação de que a verba correspondente a R$ 12.000,00 (doze mil reais) seria um despropósito quando afirma, sem comprovar, que o saldo de R$ 16.000,00 (dezesseis mil reais) não seria suficiente para a sua própria subsistência.
Ressalto, de outra banda, que não passa despercebida a renda que a separanda declarou à Receita Federal no último exercício, renda a qual decorre da participação em duas sociedades. Entretanto, segundo justificou, atualmente não recebe renda da empresa que possui com o ex-marido, pois atuou tão-somente como laranja. E a sua participação na empresa de construção do pai pouco lhe rende. Tais alegações obviamente serão melhor apreciadas na instrução do feito. Não se enganem as partes a este respeito. Contudo, ao meu sentir, são alegações verossímeis, se considerarmos a renda do casal como um todo, e me servem como referência, pelo menos por enquanto, para manter o pensionamento para as três recorridas, intuito familiae. .
De mais a mais, preciso salientar que não vejo o momento processual atual como divisor de águas entre a vida levada pela família quando todos estavam juntos e a vida que passarão a levar. O momento é delicado, e quanto menor o impacto no padrão de vida das crianças envolvidas, tanto melhor. Esta é a minha posição. Ou seja, se não acarretará a bancarrota do recorrente, que logrará subsistir com a maior fatia de seus alegados rendimentos, aguardemos até que as despesas efetivas das alimentadas se consolidem, e até mesmo que a separanda consiga se reorganizar não só afetiva como profissionalmente. Feito isso, por certo que o juízo a quo logrará fixar pensionamento adequado, munido de elementos probatórios bem mais consistentes.
O que importa esclarecer é que não estou aqui definindo a verba alimentar intuito familiae fixada como a correta ante as necessidades especificas das recorridas e as possibilidades exatas do recorrente. Não. Estou aqui definindo verba que permitirá às agravadas lidar com o mesmo conforto que desfrutavam até pouco tempo atrás até que se reorganizem face ao novo momento que passarão a vivenciar.
Destarte, em sede de cognição sumária, creio que a manutenção da minha decisão liminar lançada nos autos do agravo nº 70034485656 para fixar os alimentos provisórios em R$ 12.000,00 (doze mil reais), em observação ao binômio necessidade-possibilidade, insculpido no artigo 1694, §1º, do Código Civil, é a melhor solução à questão posta.
Finalmente, destaco que não reconsiderei a decisão segundo a qual determinei fossem abatidas do pensionamento os pagamentos diretos de previdência privada das filhas, mensalidade escolar e empregada doméstica, pois evidente que se reverteram em proveito das alimentadas, assim como o plano de saúde deverá ser devidamente abatido se permanecer sob a titularidade do varão.
Ante o exposto, NEGO PROVIMENTO AO RECURSO.
